In the previous episode, we covered my April 2021 meeting with NCP Brazil's leadership, when I learned of additional questions to Eni and the possibility of Good Offices.
But Eni had already submitted its first formal response.
📌 MARCH 9, 2021 — ENI'S RESPONSE
In a nine-page letter signed by Chief Legal Officer Stefano Speroni, Eni presented its version of events, challenging my complaint and the continuation of the proceedings.
🔹 ALLEGATIONS OR DOCUMENTARY EVIDENCE?
My July 2020 complaint was supported by dozens of documents.
Eni's response revealed a fundamental difference:
The company attached no supporting documents or links enabling NCP Brazil to verify its allegations.
Eni presented its version. But where was the evidence?
🔹 WHAT DID ENI ALLEGE?
The company:
• Cited previous judicial proceedings to challenge my complaint.
• Questioned the relevance of new Petrobras documents.
• Questioned my motives for seeking an amicable settlement.
• Expressed reservations about Good Offices.
These were Eni's allegations, not NCP Brazil's findings.
🔹 TWO VERSIONS. ONE FUNDAMENTAL QUESTION.
On one side, a complaint supported by extensive documentary evidence.
On the other, a corporate response without supporting documents to verify its assertions.
In my assessment, Eni sought to discredit my allegations through a defensive narrative that manipulated and distorted important events in the Flinto Case.
But don't simply accept my assessment.
Examine both documents. Compare the statements with the evidence. Reach your own conclusions.
🔹 WHY DIDN'T I IMMEDIATELY CHALLENGE THESE ALLEGATIONS?
My priority was different.
I knew that NCP Brazil's principal mechanism for seeking a consensual resolution - as outlined by the OECD - OCDE and OECD Watch - was Good Offices.
I expected mediation to allow the facts and documents to be examined and a fair resolution pursued.
But Eni's response raised another question:
What did the company say about participating in Good Offices?
🔷 NEXT EPISODE: WHY DID ENI QUESTION GOOD OFFICES?
After more than 25 years, one question remains unanswered:
🔴 Why doesn't Eni submit the facts, the documents and the different versions regarding my dismissal to a truly independent investigation?
I am not asking anyone to believe me.
Know the facts.
Examine the supporting evidence.
And reach your own conclusion.
