EP89 - The Flinto Case reaches NCP Brazil


In the previous three episodes, we learned what a National Contact Point (NCP) is, what a Specific Instance is, how the Initial Assessment works and what Good Offices are.

Now it is time to return to the documents.

📌 On July 15, 2020, I signed a complaint against Eni before NCP Brazil, based on the OECD - OCDE Guidelines for Multinational Enterprises.

The document would be submitted as a Specific Instance.

At that point, my story with Eni was approaching its 19th anniversary.

In May 2020, following the election of Eni’s new Board of Directors, I wrote to the new Chairwoman, copying the other Board members, including CEO Claudio Descalzi, and requested that the Flinto Case finally be examined by Eni.

When I submitted my complaint, I had still received no response from the company. But that Specific Instance was not simply a retelling of my story.

I identified which provisions of the OECD Guidelines I believed should be examined in light of the facts and documents presented.

Among them:

🔹 GENERAL POLICIES One provision recommended that enterprises refrain from discriminatory or disciplinary action against workers who make bona fide reports about practices that contravene the law, the Guidelines or the enterprise’s policies

🔹 DISCLOSURE I also invoked provisions concerning policies and codes of conduct, as well as internal audit, risk management and compliance systems

🔹 HUMAN RIGHTS The complaint also cited provisions stating that enterprises should respect human rights, avoid causing or contributing to adverse human rights impacts, and address such impacts when they occur

I was not asking NCP Brazil simply to believe my version.

I was submitting facts, documents and the different versions regarding my dismissal for examination under an institutional mechanism established by the OECD Guidelines.

And the complaint had a clear objective.

After almost 19 years, I hoped to restore my name, my honour and my reputation.

At the end of the document, I expressly requested that NCP Brazil offer its:

📌 GOOD OFFICES

the mechanism examined in the previous episode.

But submitting a Specific Instance did not mean that NCP Brazil would accept it.

First, there would be an Initial Assessment.

What did NCP Brazil do after receiving my complaint against Eni?

Did it request additional clarifications?

And, most importantly:

🔴 Was the Flinto Case Specific Instance accepted?

🔴 Why doesn’t Eni submit the facts, the documents and the different versions regarding my dismissal to a truly independent investigation?
