Ep86 - What is NCP Brazil?

In the previous episode, I showed that, when responding to the questions submitted on my behalf at Eni’s 2021 Annual General Meeting, Eni itself referred to a proceeding I had initiated before NCP Brazil.

🔹 But what exactly is an NCP?

NCP stands for National Contact Point.

According to OECD Watch, every government that adheres to the OECD - OCDE Guidelines for Multinational Enterprises must establish a National Contact Point.

An NCP is a government-supported office whose core duty is to advance the effectiveness of the OECD Guidelines.

🔹 How does an NCP do this?

According to OECD Watch, essentially in two ways.

First, by promoting and raising awareness about the OECD Guidelines and the NCP grievance mechanism among businesses, civil society and other stakeholders.

Second - and particularly important to this story - by handling complaints against companies alleged to have failed to meet the standards of the OECD Guidelines.

📌 An NCP therefore has a dual mandate:

1️⃣ to promote the Guidelines

2️⃣ and to serve as a grievance mechanism.

Although governments have flexibility in structuring their NCPs, OECD Watch explains that all NCPs must operate according to seven core effectiveness criteria:

🔹 visibility, accessibility, transparency, accountability, impartiality and equitability, predictability, and compatibility with the Guidelines.

📌 And where does NCP Brazil enter this story?

Brazil adheres to the OECD Guidelines and therefore has its own National Contact Point.

It was precisely this institutional mechanism that I decided to approach in 2020, after once again bringing the Flinto Case to Eni’s Board of Directors and receiving no response.

But a complaint submitted to an NCP has a specific name under the OECD Guidelines system:

🔹 “SPECIFIC INSTANCE.”

What does this expression mean?

Who can file a Specific Instance?

And what happens after it reaches a National Contact Point?
